Your Data: Access and Deletion

Version 1.0 · Effective 9 September 2026
This page explains what you can ask us to do with your data, exactly how to ask, what happens next, and how long it takes. It is written to be used, not admired — if you want to skip to the part that tells you where to send a request, that is section 3.
What we collect and why is set out in our Privacy Policy, and our handling of health data specifically is set out in our Consumer Health Data Privacy Policy.

1. The rights you have

You can ask us to:
Right
What it means
Know
Tell you what categories of data we hold about you, where we got it, what we use it for, and which companies process it for us.
Access
Give you a copy of the data we hold about you. We put that copy together by hand — there is no export button in the app.
Correct
Fix data about you that is wrong.
Delete
Erase your data, and close your account if you want that too.
We extend every one of these rights to every user in the United States, whatever state you live in. We do not check which state you are in before deciding whether you have a right. Some states give their residents these rights by law; we give them to everyone.
Nied Fitness is offered in and intended for the United States, and for adults aged 18 or over.

2. Three things you do not need to ask us for

We do not sell your data. Not to advertisers, not to data brokers, not to anyone, and we never will. There is no opt-out to give you because there is no sale to opt out of.
We do not share your data for advertising. There is no advertising in Nied Fitness, there are no advertising SDKs in it, and we do not disclose anything about you for cross-context behavioural advertising. Our revenue comes from subscriptions and nothing else.
We do not send marketing email. There is no marketing list, no newsletter, and nothing to unsubscribe from. The only emails Nied Fitness sends you are a password reset link, an email verification link, and a status update when a report you sent us changes or gets a reply. If you subscribe, we also owe you the notices in the Subscription, Billing & Auto-Renewal Terms before a price change or a material change to those terms — those are about your subscription, not marketing, and there is nothing to unsubscribe from. You can switch the report-status email off yourself: your account menu → Settings → Email notifications. The matching in-app notification still arrives.

3. How to make a request

Email us at support@niedfitness.com from the email address on your account, and tell us which of the rights in section 1 you want to use. That is the whole requirement. You do not need a particular form of words.
Some of it you can do yourself:
Request
In the app
By email
Know what we hold, or get a copy of it
Not available in the app. There is no export feature.
Correct your data
Your preferred name and your timezone: account menu → Account. For your full name, email, birthdate or biological sex, which the app shows but does not let you edit: account menu → Settings → About you → Request a change. An admin reviews every request and you get a notification with the outcome.
Delete specific things
See the note below.
Delete your account and everything in it
Account menu → Account → Delete account. You type a confirmation phrase, and the deletion runs immediately.
What you can delete yourself, precisely. A workout session. A goal. An equipment context, or a single item inside one. An exercise you marked as a favourite. A Virtual Coach conversation — on the tiers where the Virtual Coach is enabled. That is the whole list. Your body scan measurements, the reports you have sent us, and your training history as a whole cannot be deleted item by item from inside the app; email us, or delete the account.
You often do not need to ask about Virtual Coach conversations. A conversation is archived automatically after 7 days with no activity and permanently deleted after 30 days with no activity, whether or not you do anything.
Someone acting for you. If you want an authorised agent to make a request on your behalf, email support@niedfitness.com and we will explain what we need before you send anything.

4. How we check that it is really you

We have to be sure a request is genuinely yours. Your workouts, your body metrics, and your Virtual Coach conversations are sensitive, and handing them to the wrong person would be a serious harm — so would deleting them at a stranger's request.
We keep verification as light as we reasonably can:
  • •
Normally, all we need is that you write from the email address on your account, and reply to a confirmation we send back to that same address.
  • •
For deletion of your whole account in the app, you are already signed in, and you confirm by typing a phrase into the confirmation box, so that nobody loses years of training history to a mis-click.
  • •
If something does not line up — the address does not match, or the request comes through an agent — we may ask a small number of additional questions about information already on your account.
We will never ask you for a government ID, a Social Security number, a photograph of yourself, or a copy of a document, and you should not send us one. We do not collect those things and we do not want them. We will only ever ask for information we already hold, and we use anything you send purely to verify the request and then delete it.
If we genuinely cannot verify that a request is yours, we will tell you why, and we will not simply ignore it.

5. How long we take

  • •
We acknowledge your request within 10 calendar days of receiving it.
  • •
We complete it within 45 calendar days of receiving it, including the time spent verifying who you are.
  • •
The extension. If a request is genuinely complex or we have received a large number at once, we may extend once, by up to a further 45 calendar days. If we do, we will tell you before the first deadline runs out, and we will tell you the reason — not just that an extension has been taken.
The clock starts when your request arrives, not when we get round to it.
Deleting your account inside the app is not a request and does not wait for any of this. It happens as soon as you confirm.

6. What deletion actually does

Deletion is meant to be real. Here is precisely what happens.

6.1 When it happens

  • •
In the app, deletion is immediate. Confirming it runs a single database transaction that removes your records, and it is done before the screen changes. Your subscription is cancelled at the same moment, and your sign-in stops working.
  • •
By email, we complete the deletion within the timeline in section 5 — 45 calendar days, or up to 90 if we have to take the one extension and have told you why. There is one clock for every request; deletion does not have a separate one.
  • •
The outer bound. Our database keeps a rolling restore history of no more than 7 days, so that a bad deployment can be recovered, and a deleted record still sits inside that history until the window rolls past it. The point by which your data is gone from every copy of our database is therefore the deletion plus that window: immediate plus 7 days if you did it yourself, at most 90 days plus 7 if you asked us and we took the extension. If we ever restore inside that window, we reapply the deletion.

6.2 What we erase

  • •
Your sign-in: email address, password credential, any Google sign-in link, and any outstanding password-reset or email-verification tokens.
  • •
Your profile and settings, including preferred name, timezone and units.
  • •
Your training data: workout sessions, the sets and weights inside them, your personal records, your exercise favourites, and the exercise preferences the app has learned from you.
  • •
Your equipment contexts and everything in them.
  • •
Your health-adjacent records: goals, body scan measurements, injuries, soreness, and availability.
  • •
Your full Virtual Coach conversation history, including anything you told it about a medical condition, injury, medication, or symptom, and the tool-audit and usage rows recorded for those conversations.
  • •
Your notifications and your email notification preferences.
  • •
Reports you sent us, the message threads on them, and any screenshots you attached.
  • •
Any profile change request you sent us.

6.3 What we keep, and why

We cannot delete everything, and we would rather say so than have you discover it later:
What we keep
Why
How long
Billing and transaction records held by our payment processor — what you paid, when, and for what. We never hold your card number; the processor does
It is the processor's own financial and legal record, not ours to erase
Set by the processor, not by us
Our internal log of what our staff did in the admin tools
It is evidence about us, not a record about you, and deleting it would destroy the accountability it exists for
Six years by default
A support ticket our staff opened from a report you sent, with your account id removed from it
The work item outlives the account; after the deletion nothing in it points back to you
No fixed limit
A signup invite you redeemed, with your account id removed from it
The invite is the record of who invited whom; after the deletion it no longer names you
No fixed limit
Server request logs at our web host, which include your IP address and browser type
These are how we keep the service running, protect accounts, and investigate faults
Not deleted as part of an account deletion — see section 6.4
Product-analytics and error records at our analytics provider, keyed to an opaque account id — never your name, your email or your IP address, which we strip from every event before it is sent
The same reason: keeping the service working and finding faults
Not deleted as part of an account deletion — see section 6.4
Sign-in rate-limit counters, which record the IP address a sign-in attempt came from, in our own database
They are what stops someone guessing passwords against your account
Seven days. A daily job deletes any counter older than that. An account deletion does not remove them earlier; the seven-day sweep does
Anything we are required by law to keep, or that we need to establish or defend a legal claim
Legal obligation
Only as long as that reason lasts
We do not keep your health data on any of these grounds. Billing records tell us that a subscription was paid; they do not contain your workouts, your body metrics, or your conversations.
Two things we are not keeping, which you might expect us to. Your email notification preference is deleted along with everything else — it is not a suppression list, and because we send no marketing there is nothing for one to suppress. And when you delete your account yourself in the app, no record of the deletion is written at all: there is no log entry saying you asked and we did it.

6.4 What deletion reaches outside our own database

Deleting from our own database is not the whole story, so here is where it stops.
Deletion does reach two places beyond the database itself: the screenshots you attached to reports are deleted from our object storage, and any active subscription is cancelled at our payment processor.
Deletion does not automatically reach our web host's request logs, our product-analytics and error-monitoring provider, our email provider, or the AI provider behind the Virtual Coach. We delete our copy of your Virtual Coach conversations; we have no agreement with our AI provider requiring it to delete its own copy of what we sent, or not to train on it, and we will not tell you otherwise until we do. Our Privacy Policy names each of these companies and says what each one receives. If you want a deletion passed on to any of them, ask us and we will pass it on.

7. Before you delete: get a copy, and know what it ends

Ask us for a copy first if you want one. Email support@niedfitness.com before you delete. There is no export button, so we put the copy together by hand, which takes time — start it before you press delete, not after. Once the deletion is done we cannot recover your data, and neither can you.
Deleting your account cancels any active subscription immediately. You lose the remainder of the period you have already paid for, and deleting does not by itself entitle you to a refund. If you have paid for the current period and want to use it, cancel first, use the time you paid for, and delete afterwards.
Cancellation, billing, renewal, and the limited refund position — including the three-business-day cancellation right for California residents — are set out in the Subscription, Billing & Auto-Renewal Terms.

8. If we say no

Sometimes we will refuse a request — because we could not verify it, because an exception applies, or because part of what you asked for is data we are required to keep. If that happens we will tell you which part we refused and why, in writing, rather than leaving you to work it out.
You can appeal. Reply to our decision, or email support@niedfitness.com with "Appeal" in the subject line. We will review the decision afresh and write back within 45 calendar days explaining the outcome and our reasoning. We will not pretend a second, independent reviewer exists — Nied Fitness is small enough that the same people would be doing the reviewing, and saying otherwise would be a promise about our size rather than about your rights. Appealing costs you nothing and does not affect your account.
If you are still not satisfied, you can complain to a regulator:
  • •
For health data — your workouts, body metrics, and Virtual Coach conversations — the consumer health data laws that give you these rights are Washington's and Nevada's. If you live in Washington, that is the Washington State Attorney General's Office; if you live in Nevada, the Nevada Attorney General's Office.
  • •
Wherever you live, you may contact the Attorney General of your own state.
We will tell you about these routes in the decision itself, so you do not have to come back to this page to find them.

9. We will not treat you differently for asking

Exercising any right on this page will never cause us to deny you the service, charge you a different price, give you a lower quality of service, or penalise your account. There is no cost to making a request, and no limit we apply to reasonable requests.
The only consequence is the direct one we have described: deleted data is gone.

Versions

Every version we have published, newest first. You can read any of them.
  • Version 1.0 · Effective 9 September 2026 · current
Material change. First published version, rewritten against the shipped product — it describes the account deletion the app actually performs, states that there is no export feature and no marketing email, and removes the consent-withdrawal right the product has no mechanism for.
