Subscription, Billing & Auto-Renewal Terms

Version 1.0 · Effective 5 October 2026

1. What these terms cover

1.1 Who we are. These terms are between you and the people who operate Nied Fitness ("we," "us," "our").
1.2 What this document does. It sets out how a paid Nied Fitness subscription is priced, how and when we charge you, how it renews automatically, how you cancel, and how refunds and taxes work.
1.3 It is part of your agreement. These terms form part of our Terms of Service. Where the two differ on anything to do with price, billing, renewal, cancellation, refunds or taxes, these terms control.
1.4 The Beta. During the Beta period, the Beta Program Terms also apply.
1.5 Read this before you subscribe. This is the document that explains what you are agreeing to pay and how the charges recur.

2. What you are paying for

2.1 Plus is the paid plan. A Plus subscription unlocks the Virtual Coach, including asking it to build and adjust sessions for you. The rest of the app — including planning and tracking your own workouts by hand — is available without a subscription. Your use of the Virtual Coach is subject to the Virtual Coach Terms & AI Disclosure.
2.2 Some accounts hold a paid plan at no charge. If you were invited and given a paid plan, nothing is charged to you. The Subscription screen shows your plan as included free, and the rest of this document about charging and renewal does not apply to you until you subscribe yourself.
2.3 There is no free trial. Subscribing starts a paid subscription straight away.
2.4 Web only. You subscribe and pay on our website. There is no app-store billing.
2.5 Features can change. As explained in the Terms of Service, we may add, change or remove features. You are buying access to the Service as it exists at the time you pay; we do not promise features that are not in it. If we materially reduce what your plan includes, Section 6 gives you the right to cancel before the change takes effect.

3. Price

3.1 Where the price is shown. The price and the billing period are shown to you before you subscribe, and again on the checkout page before you confirm. You choose whether to be billed monthly or annually. The plan and billing period you are on are shown in your account menu under Subscription.
3.2 The Beta rate. If you subscribe during the Beta, you pay 50% off the standard price of your plan. The discount and the price you will pay are shown before you subscribe.
3.3 How long the Beta rate lasts. The Beta rate runs through the Beta period and for one year after the Beta marketing period ends. Then the standard price applies. "The Beta marketing period" is defined in the Beta Program Terms — in short, the window in which we are still recruiting beta members, ending no later than public launch — and we publish the date it ended.
3.4 The end date is the same for everyone. The Beta rate is not measured from the day you subscribed. Every member on the Beta rate loses it on the same date.
3.5 Two examples. These are illustrations. They use an assumed date, not a date we have set.
  • •
Suppose the Beta marketing period ends on 30 June 2027. The Beta rate then runs until 30 June 2028.
  • •
A member who subscribed on 5 October 2026 and a member who subscribed on 1 May 2027 both pay the Beta rate until 30 June 2028. Subscribing earlier does not buy you a longer discount, and subscribing later does not cost you one.
3.6 We will give you notice before it ends. We will tell you the date the Beta rate ends, and the price that applies afterwards, before it happens. After that date your subscription continues at the standard price unless you cancel first.
3.7 Currency. All prices are in United States dollars. Nied Fitness is offered in, and intended for, the United States.

4. Billing cycle and renewal

4.1 First charge. We charge you when you subscribe. Your subscription starts immediately.
4.2 Renewal. Your subscription renews automatically and you are charged again at the start of each new billing period — every month if you chose monthly, every year if you chose annual — until you cancel. Your next renewal date is shown in your account menu under Subscription.
4.3 Who processes the payment. Payments are processed by Stripe. Stripe stores your card details; we never receive them. Your use of Stripe is subject to Stripe's own terms and privacy policy.
4.4 Your payment method. You authorise us and Stripe to charge the payment method you provide for all amounts due, including renewals, until you cancel. Keep a valid payment method on file while you are subscribed.
4.5 What the Subscription screen shows. The Subscription screen in your account menu shows your plan, your subscription status, whether you are billed monthly or annually, and your next renewal date. It does not show the amount of your next charge, and it does not show the date the Beta rate ends.

5. How to cancel

5.1 Cancel yourself, at any time. Open your account menu, choose Subscription, then Manage subscription. That opens the billing portal run by our payment processor, Stripe, where you can cancel, change your payment method, and see your invoices.
5.2 When it takes effect. The billing portal tells you when your cancellation takes effect before you confirm it. If your subscription is set to end at the close of the period you have already paid for, your account menu under Subscription shows that, along with the date your access ends.
5.3 If you cannot reach it. If for any reason you cannot get to the billing portal, email support@niedfitness.com from the address on your account and ask us to cancel. We will cancel it for you.
5.4 No refund for the part of a period you do not use. Cancelling stops future charges. It does not refund the remainder of a period you have already paid for. Section 10 (California) and Section 11 (refunds) are the exceptions.
5.5 Deleting your account cancels your subscription immediately. Deleting your account is not the same as cancelling. When you delete your account, we cancel your subscription at once — not at the end of your billing period — and you lose the rest of the period you paid for, with no refund. If you have paid for time you still want to use, cancel first and delete your account later.
5.6 Cancelling is not deleting. Cancelling stops the charges and leaves your account and your history in place. Section 13 explains what happens to your data.

6. Price and plan changes

6.1 We may change prices. We may change the price of a plan, or change what a plan includes.
6.2 Notice. We will give you at least 30 days' notice before a price increase applies to your subscription. We will send it to the email address on your account. The notice will state your current price, your new price, and the date the new price first applies.
6.3 Your choice. If you do not want to pay the new price, cancel before that date under Section 5. If you do not cancel, the new price applies.
6.4 The end of the Beta rate. Moving from the Beta rate to the standard price is not a price increase under this section — it is the pricing described in Section 3. You still get the notice described in Section 3.6.
6.5 Material reductions. If we materially reduce what your plan includes, we will tell you at least 30 days beforehand and you may cancel before the change takes effect.

7. Failed payments

7.1 If a payment fails. If a renewal charge is declined, our payment processor may try the charge again.
7.2 We tell you in the app. We show a notice in the app when a payment fails, and again when a payment succeeds after a failure. The notice links to your account menu under Subscription, where you can update your payment method.
7.3 You keep access while it is being retried. Your plan stays active while a failed payment is being retried.
7.4 If no payment succeeds. If the subscription is eventually cancelled for non-payment, your paid features stop and your account returns to the free tier. Your account and your history stay.
7.5 Amounts still owed. You remain responsible for any amount properly charged and not paid, including for a period in which you had access.

8. Taxes

8.1 Tax may be added. Where we are required to collect sales, use or a similar transaction tax, it is calculated at checkout from the address you give and added to your total. The total, including any tax, is shown to you before you confirm.
8.2 Tax changes. If the tax rate that applies to you changes, the total charged changes with it. A change in tax is not a price change under Section 6.
8.3 Your responsibility. You are responsible for any taxes on your subscription other than taxes on our income.

9. Chargebacks

9.1 Talk to us first. If you think a charge is wrong, email support@niedfitness.com before disputing it with your bank. Most problems are settled faster that way.
9.2 What happens if you file one. If you file a chargeback, we may suspend your access while the dispute is open, and we may close your account and subscription. We will give your billing records to the card network.
9.3 Amounts owed. If a chargeback is resolved in our favour, the disputed amount remains payable, together with any fee the card network charges us, to the extent the law allows us to recover it.
9.4 Resubscribing. We may decline to let an account with an unresolved chargeback subscribe again.

10. California residents — three-business-day right to cancel

If you are a California resident, you may cancel this subscription, without penalty or obligation, at any time before midnight of the third business day after the date you subscribe.
To use this right, email support@niedfitness.com from the address on your account, with the subject line California Cancellation. Say that you are cancelling, and include your full name and the email address on your account. You do not have to give a reason.
If you cancel under this right within the three-business-day period, we will refund the full amount you paid to the payment method you used, and your access will end.
This right is in addition to your right to cancel at any time under Section 5.

11. Refunds

11.1 The general rule. Subscription fees are non-refundable. We do not refund the unused part of a billing period, except where the law requires it. Section 10 and Sections 11.2 and 11.3 are the exceptions.
11.2 Charges in error. If we charge you an amount you did not agree to, or charge you after you validly cancelled, tell us and we will refund it in full. This is not discretionary.
11.3 Refunds at our discretion. We may choose to refund a payment in other circumstances — for example after a significant service failure. Ask at support@niedfitness.com. Doing it once does not oblige us to do it again.
11.4 Your legal rights. Nothing in this section limits any refund or cancellation right you have under the law of the state where you live.

12. Changes to these terms

We may change these terms. The current version is always posted in the app with its effective date. If a change is material we will give you at least 30 days' notice by email and in the app, and you may cancel before it takes effect. Continuing to subscribe after the effective date means you accept the change. Price changes are governed by Section 6.

13. Your data when you cancel or delete

13.1 After you cancel. Your account and everything in it stay. You keep using Nied Fitness on the free tier; the paid features stop when your paid period ends.
13.2 If you want a copy of your data. There is no self-service export. Email support@niedfitness.com and ask, and we will handle it by hand. Do this before you delete your account — deletion cannot be undone. See Your Data.
13.3 Deleting your account. To delete your account, open the account menu, go to Account, and choose Delete account. This cancels your subscription immediately (Section 5.5).
13.4 What deletion removes and what survives it. Your Data is the complete and controlling account of what deletion removes, what we keep, and why. One thing to know here: Stripe keeps its own record of your payments for its financial and legal purposes, and deleting your Nied Fitness account does not remove it.
