Terms of Service

Version 3.0 · Effective 9 September 2026
These terms govern your use of Nied Fitness. By creating an account or using the app, you agree to them. Please read the billing and health-disclaimer sections carefully.

The documents this agreement is made of

These terms are the core of your agreement with us, and the documents below are part of it. Each one covers a subject in more depth than we could sensibly cover here, and each is written to be read on its own.
Document
What it covers
What we collect, how we use it, and who else sees it
Health-related information specifically, and the rights that attach to it
What our information is and is not, and what to do before you train
The AI assistant: what it is, what it cannot do, and what happens to what you tell it
Price, recurring charges, cancellation and refunds
The extra terms that apply while Nied Fitness is in beta
Cookies and the other things we store in your browser
How to ask us for a copy of your data, or to delete it
Where one of those documents and these terms disagree about the subject that document covers, that document controls. Every document we publish, in every version we have published it, stays readable at /legal.

Eligibility

Nied Fitness is for adults. You must be 18 or older to create an account or use the service, and we do not offer it to anyone under 18. If we learn that an account belongs to someone under 18, we will close it.
Nied Fitness is offered in and intended for the United States.

Your account

You are responsible for the activity on your account and for keeping your credentials secure. Provide accurate information, and notify us of any unauthorized use.

Acceptable use

Use the app for your own training. Don’t misuse it — no unlawful use, no attempts to breach security or access other users’ data, no scraping or reselling, and no interference with the service’s operation.

Subscriptions and billing

Some features require a paid subscription. Paid plans are billed through our payment processor, Stripe, on a recurring basis and renew automatically until you cancel. The price and the billing period are shown to you before you subscribe. We may change prices for new subscriptions, and we will give notice of material changes to the price of an existing subscription. The full terms — including the beta rate and when it ends — are in the Subscription, Billing & Auto-Renewal Terms.

Cancellation and refunds

You can cancel anytime from your billing settings, and you are not charged again after cancellation. Payments are non-refundable except where required by law — we do not provide prorated refunds for partial billing periods.
Deleting your account cancels any active subscription immediately, which is not the same as cancelling. Cancelling leaves you with the access you have already paid for; deleting ends it at once, and you lose the remainder of the period. If you want both, cancel first and delete when the period runs out.

Health and fitness disclaimer

Nied Fitness provides general fitness and training information and is not medical advice. Consult a qualified professional before starting or changing an exercise program, especially if you have a health condition or injury. You use the app and perform any exercises at your own risk. This is set out in full in the Health & Safety Disclaimer, and the limits of the AI assistant specifically are in the Virtual Coach Terms & AI Disclosure.

Your content and our service

You own the training data you create. You grant us the limited rights needed to operate the service for you (such as storing and processing your data, as described in our Privacy Policy). We own the app, its software, and its branding.

Disclaimers and limitation of liability

The app is provided “as is,” without warranties of any kind. To the extent permitted by law, Nied Fitness is not liable for indirect, incidental, or consequential damages arising from your use of the service.

Suspending or ending your account

You can stop using Nied Fitness at any time, and delete your account from your account menu under Account.
We may suspend or close an account if it breaks the acceptable-use rules above, if it is used for fraud or abuse, if payment for it fails and is not put right, or if the person using it is not eligible under Eligibility. Where the circumstances allow it, we will tell you first and give you a chance to put it right; where they do not — an active security or safety problem — we may act first and tell you afterwards.
If we close a paid account for a reason that is not your fault, we refund the part of the period you paid for and could not use. If we close it for a breach, we do not.
We may also stop offering Nied Fitness, or part of it. If we do, we will give you reasonable notice and will not charge you again after that notice.
Ending your account does not undo what came before it. The sections on your content and our service, disclaimers and limitation of liability, and governing law continue to apply.

Changes to these terms

We may update these terms as the app evolves. We publish a new version with a new effective date, and for material changes we give a more prominent notice. Continued use after a change means you accept the updated terms.

Governing law

These terms are governed by the laws of the State of Utah, USA, without regard to its conflict-of-laws rules.

  • Version 3.0 · Effective 9 September 2026 · current
Material change. The agreement now names every document it is made of, eligibility gets its own section, and the cancellation clause states that deleting your account ends the subscription immediately rather than at the end of the period.
  • Material change. Eligibility is now 18 and over, framed as an exclusion; the beta cohort pricing paragraph is removed until the beta price term is ruled on (nothing is charged today).
  • Material change. First publication — the Terms of Service as live at /terms since 23 June 2026 (Phase 29.3), carried into the framework verbatim.
