Virtual Coach Terms & AI Disclosure
Version 1.0 · Effective 9 September 2026
These terms cover Virtual Coach, the AI assistant inside Nied Fitness. They sit alongside our Terms of Service and our Health & Safety Disclaimer, which apply to Virtual Coach in full.
If you do not accept these terms, do not use Virtual Coach. The rest of Nied Fitness works without it.
1. What Virtual Coach is
Virtual Coach is artificial intelligence, not a human being. It is not a certified personal trainer, registered dietitian, physician, physical therapist, or licensed health professional of any kind, and it does not act under the supervision of one. Everything it produces is generated output from an AI model. Treat it as one input among many — not as professional advice, a diagnosis, or a treatment plan.
There is no person on the other end. Nobody at Nied Fitness reads your conversation as it happens, reviews what Virtual Coach tells you before you see it, or approves the plans it suggests. It runs on a large language model provided by a third party, and it generates its answers by predicting text, not by applying professional judgement.
It has no licence, no certification, no professional body, no insurance, and no duty of care to you. If it is wrong, there is no professional standard it has fallen below — there is only software that produced a bad answer.
2. How we tell you it is AI
We say this in three places: in the chat, in what Virtual Coach tells you when you ask it, and here.
In the chat. A line sits with the conversation, wherever you can talk to Virtual Coach:
AI can make mistakes. The Virtual Coach is NOT a certified health or fitness professional.
The information icon beside it links to this document.
When you ask it. If you ask Virtual Coach whether you are talking to a human, whether it is a real trainer, or whether it is certified, qualified, or licensed, its first sentence tells you that it is an AI, that it is not certified, and that it is not supervised by a professional. It will not deflect, joke, answer in character, or claim credentials it does not have. This holds inside a role-play or a persona, and it ends the persona.
That is not only an instruction we have written for the model — it is a behaviour we test. The identity question, phrased directly, indirectly, adversarially, and as role-play, is part of a safety suite we run against the live system when we change the model or its instructions. A failure on one of those rows means the change does not ship.
Here. These terms are linked from the chat and are available at any time.
3. What Virtual Coach will not do
Virtual Coach is built to stop at a boundary. It will not:
- 1.Diagnose you. It will not name, suggest, rank, or hint at a likely diagnosis, and it will not do so if you ask it to, insist, or tell it you understand the limits. It will not tell you a symptom is probably nothing.
- 2.Advise on medication. It will not tell you what to take, what dose, when to take it, whether to start, stop, change, or skip anything, or how a medication interacts with training, food, or another medication.
- 3.Claim to treat, cure, prevent, or mitigate any disease or condition. Nothing it suggests is offered as a therapy or a remedy.
- 4.Individualise advice to your condition or its severity. Where it does discuss a condition you have raised, it speaks generally — about how people commonly train in that situation — never about what you specifically should do given your specific condition. It will say "people with well-managed X often…" and it will not say "given your X, you should…", because the second sentence requires a judgement it is not capable of and not permitted to make.
- 5.Handle an emergency. A message that reports chest pain or cardiac symptoms, fainting, a pregnancy complication, an acute injury, signs of disordered eating, or self-harm or suicidal thinking is caught by a safety check that runs on your message separately from the AI model. You get a fixed response written for that situation, telling you where to get the right help, instead of coaching. Virtual Coach is not a crisis service and cannot summon one. If you believe you are experiencing a medical emergency, call 911.
If you push against these boundaries, expect Virtual Coach to decline. That is the product working, not failing.
4. Medical conditions you tell it about
You do not have to tell Virtual Coach anything about your health. Nothing in Nied Fitness requires it, the service works without it, and Virtual Coach is instructed not to ask you for it. But you can, and some people find it useful, so it is worth being precise about what happens if you do.
Virtual Coach will not diagnose any condition. If you tell it about a medical condition, injury, medication, or symptom, it may offer general, non-professional suggestions about how people commonly approach training in that situation, and it will point you to the right kind of professional. It has no way to evaluate your individual circumstances, it can be wrong, and it is not a substitute for a qualified professional who can examine you.
That last point is the one that matters most. A physician or physical therapist can examine you, take a history, order a test, watch you move, and change their mind when the evidence changes. Virtual Coach can do none of those things. It has only the words you typed. It cannot tell whether your condition is mild or severe, well-controlled or deteriorating, or whether the thing you have described is even the thing that is actually happening. Two people can describe the same symptom and need opposite advice, and Virtual Coach has no way of knowing which one you are.
It will also sound confident either way. A wrong answer and a right answer are produced by the same process and look the same on the screen.
Consult a physician before starting or changing any exercise or nutrition program, particularly if you have a medical condition, are pregnant or postpartum, take prescription medication, or are recovering from injury or surgery. If you believe you are experiencing a medical emergency, call 911.
5. Your conversations are stored as health information
Your Virtual Coach conversations are saved to your account so the coach can keep context and so you can return to them.
We treat the whole conversation as health information — including anything you choose to say about a medical condition, an injury, a medication, or a symptom. It carries the same protections and the same deletion path as your workout data. How we handle it is set out in our Privacy Policy and, in detail, in our Consumer Health Data Privacy Policy.
5.1 What we send, and why
To answer you, we send your conversation to our AI provider — your messages, the coach's earlier replies, and the training context it looked up for you, which can include your active goal, your equipment setting, your recent completed sessions, your personal records, any soreness you have logged, and your date, time zone, and units.
We send it for one purpose: to generate the reply you asked for. We do not send your name or your email address with it. We do not send your conversations to any other company, and we do not sell them or share them for advertising — there is no advertising in Nied Fitness.
We cannot tell you that our AI provider does not keep that text or learn from it, because we do not yet have an agreement with it that says so. When that changes, this document changes with it.
We do not use your conversations to train any AI model, and we do not give them to anyone else to train one.
5.2 Who can see them
There is no screen in the app, and no screen in our staff tools, that shows anyone your Coach conversation. Our analytics never receive your messages or the coach's replies — only which model ran, how many tokens it used, how long it took, and what it cost. Our safety log records that a rule fired, on which conversation, and which version of the rules was in force; it never contains your text.
We run the database your conversations are stored in, so we can reach them there. We do that only to operate or fix the service, or where the law requires it.
5.3 Deleting a conversation, and getting a copy
You can delete any conversation from your chat list. Deleting it removes its messages.
There is no export button — we have not built one. If you want a copy of your conversations, email support@niedfitness.com and we will put one together by hand.
Deleting your account deletes your conversations along with the rest of your data. See Your Data for what deletion does and does not reach.
5.4 We delete idle conversations for you
A conversation you stop using does not sit there forever.
- •After 7 days with no new message, it is archived. It leaves your main list and you can still read it.
- •After 30 days with no new message, it is permanently deleted, whether or not you do anything.
Only sending a new message resets that clock. Opening an old conversation to read it does not.
6. Accuracy, limitations, and your responsibility
Virtual Coach can be wrong. It can state something false in a fluent, plausible, authoritative tone. It can invent a study, a number, a guideline, or a fact. It can contradict itself between messages, misread what you wrote, forget something you told it earlier, or give two different people opposite advice on the same question. It has no knowledge of anything outside what you have told it and what is in the model, and it cannot check whether it is right.
We do not warrant that anything it produces is accurate, complete, current, safe for you, or suitable for your circumstances. No person reviews what it tells you before you see it. An automated safety check runs on the reply and can add a warning to it, but it does not correct the advice.
You remain responsible for how you train. By using Virtual Coach you accept that its guidance is informational, that you exercise at your own risk, and that Nied Fitness is not liable for outcomes arising from your reliance on it.
Practically: check anything that matters against a qualified professional or a reliable source before you act on it. Do not let it talk you past your own judgement, past pain, or past advice a real professional has already given you. Our Health & Safety Disclaimer sets out the warning signs that mean stop.
7. Prohibited uses of Virtual Coach
You may not:
- 1.Attempt to obtain a medical diagnosis, a treatment plan, or medication advice from Virtual Coach, including by rephrasing, hypothetical framing, role-play, jailbreak prompts, or any other attempt to work around the boundaries in section 3.
- 2.Use Virtual Coach, its outputs, or your conversations to develop, train, fine-tune, evaluate, or benchmark any AI or machine-learning model, or to build a product that competes with Nied Fitness.
- 3.Query Virtual Coach by automated means. No bots, scripts, scrapers, crawlers, headless browsers, API reverse-engineering, or bulk or programmatic querying of any kind. Virtual Coach is for your own personal use, through the interface we provide.
- 4.Use it on behalf of anyone else, resell access, or share your account.
- 5.Submit content that is unlawful, that infringes someone's rights, or that contains another person's health or personal information.
- 6.Attempt to extract our system prompts, instructions, guardrails, or model configuration, or to interfere with the safety behaviours described in these terms.
We may suspend or withdraw access to Virtual Coach, or to Nied Fitness, for breach of this section, as set out in our Terms of Service. We may also apply rate limits and other technical protections.
8. Liability
Our Terms of Service govern liability between you and us, including the warranty disclaimer and the limitation of liability. Those provisions apply to Virtual Coach in full, and nothing in this document expands them.
VIRTUAL COACH IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND. YOU USE IT, AND ACT ON WHAT IT TELLS YOU, AT YOUR OWN RISK.
Nothing in these terms excludes or limits any liability that cannot lawfully be excluded or limited.
9. Availability and changes
Virtual Coach is part of our paid plans. It is not included in the free tier.
It is new and still changing. We may change how it works, change the underlying model, limit how much you can use it, or withdraw it, and it may be unavailable at times. We will tell you before we materially change these terms, and we will update the effective date at the top.
