Beta Program Terms
Version 1.0 · Effective 5 October 2026
1. What these terms cover
1.1 Who we are. These terms are between you and the operator of Nied Fitness ("we," "us," "our").
1.2 What this document does. It sets out the extra terms that apply because you are using Nied Fitness during its beta period — what the beta is, what it does and does not promise, and what changes when we launch publicly.
1.3 It is part of your agreement. These terms apply in addition to the Terms of Service and the Subscription, Billing & Auto-Renewal Terms.
1.4 Which document wins. Where these terms and the Terms of Service differ, these terms control for the beta period only. These terms do not override the Subscription, Billing & Auto-Renewal Terms on anything to do with price, billing, renewal, cancellation, refunds or taxes — that document controls those, and Section 7 below simply repeats its pricing rule so you can find it in one place.
1.5 These terms end at launch. These terms sunset when the beta ends (Section 11). The Terms of Service, the billing terms and the other documents continue.
2. What the beta is
2.1 An early version of a live product. The beta is a real, working version of the Nied Fitness web application that you use with your real training data. It is not a demo, a sandbox or a preview environment.
2.2 It is still being built. The beta exists so that we can run the product with real users, find what is broken, and decide what to build next. Things will change during the beta, sometimes without warning.
2.3 When it runs. The beta opens on Monday, 5 October 2026 and runs until public launch, which we currently expect in January 2027. We may extend or shorten that period.
2.4 What "the beta marketing period" means here. Your discount is measured from the end of the beta marketing period, so it needs a definition rather than a feel. The beta marketing period is the window during which we are still recruiting people into the beta. It ends on the earlier of public launch, or the day we announce that we have stopped taking new beta members. It cannot end later than public launch. We will publish the date it ended, and we will tell you before your discount ends — see Section 7.
2.5 What "public launch" means here. Public launch is when we open the Service beyond the beta. At launch we currently expect to open signups to the public, to offer a free tier anyone can sign up for, to offer the Service on iOS and Android as well as the web, and to launch community features. Section 8 explains what is and is not promised about that.
3. Who can join the beta
3.1 By invitation. Beta access is by invitation. You need a valid invitation link to create an account — there is no open signup. An invitation is single use and expires, so use it when you get it.
3.2 What you pay. Some beta places are granted at no charge. Otherwise a paid subscription is how you get a paid tier. If you subscribe, the price and the billing period are shown to you before you subscribe, and the Subscription, Billing & Auto-Renewal Terms govern the payment. A new account starts on the free tier until a paid tier is granted or purchased.
3.3 18 or older. You must be at least 18. There is no route into the beta for anyone under 18.
3.4 United States. The Service is offered in and intended for the United States. It is not offered or directed to residents of the European Union, the European Economic Area or the United Kingdom.
3.5 Web only. The beta is a web application used in a browser. There are no Nied Fitness mobile apps during the beta, no app-store purchases, and no connections to Apple Health, Google Health Connect, wearables or fitness trackers.
3.6 One account. One account per person. Do not share your account or your sign-in details with anyone.
4. Invitations, and closing the beta
4.1 We decide how many places there are. We issue invitations ourselves, and we decide how many to issue and to whom. There is no queue you can buy your way into.
4.2 We may close the beta at any time. We may pause, limit or close beta signups at any time, for any reason, without notice. We may also revoke an invitation before it is used. Holding an unused invitation, being on a waiting list, or having started a signup you did not finish gives you no right to a place in the beta and no right to the beta rate.
4.3 Closing signups does not affect you if you are already in. If you already hold an active paid subscription, closing signups does not end your subscription and does not affect your beta rate. Section 7 governs your rate.
4.4 We may decline or remove a signup. We may decline a signup, or close an account and refund what it has paid, where we reasonably believe the person does not meet Section 3, or where a signup appears to be duplicated, automated or fraudulent.
5. The beta is provided as-is
5.1 As-is. The beta Service is provided "as is" and "as available." The disclaimer of warranties in the Terms of Service applies in full, and applies with particular force during the beta.
5.2 No uptime commitment. We make no commitment about uptime, availability, response time or maintenance windows during the beta. There is no service level agreement, no uptime target and no credit for downtime. The Service may be unavailable, slow, or partially broken, with or without notice, including during working hours and including for extended periods.
5.3 Bugs and errors. The beta may contain defects. Calculations, analyses, trends, program logic and Virtual Coach responses may be wrong. Do not treat any output as verified. The health and safety disclaimer in the Terms of Service, the Health & Safety Disclaimer and the Virtual Coach Terms & AI Disclosure apply throughout, and matter more here than in a settled product.
5.4 Features may change or be removed. We may add, change, restrict or remove any feature at any time during the beta, including a feature that was working when you subscribed and including one you rely on. We are not obliged to give notice, to keep any feature, or to replace a removed feature.
5.5 Limits. We may impose or change usage limits during the beta, including limits on Virtual Coach usage, without notice.
5.6 Support. You can email us at support@niedfitness.com. We will try to help, but we do not commit to any response time during the beta.
5.7 Liability. The limitation of liability in the Terms of Service applies to everything in this document.
6. Data loss is possible
6.1 Say it plainly. Your data may be lost, corrupted, reset or made permanently unrecoverable during the beta. This can happen through a defect, a failed migration, a change to how data is stored, a vendor failure, or an error on our part. We take reasonable care, and we still cannot promise it will not happen.
6.2 We are not a backup service. You are responsible for keeping your own copies of anything that matters to you.
6.3 There is no export feature. The app cannot produce a file of your data. You can read your training history in the app, and you can ask us for a copy by emailing support@niedfitness.com — we put that together by hand, so allow time for it. Your Data explains what you can ask for.
6.4 No compensation for data loss. We do not compensate for lost data. This does not limit any right you have that cannot be limited by agreement.
7. Your price during the beta
7.1 The rule. If you subscribe during the beta period, you pay 50% of the standard price for your plan. That rate runs through the beta period and for one year after the beta marketing period ends. After that, the standard price applies.
7.2 One end date for everyone. The beta rate is not a per-person clock. It does not run for twelve months from the day you happened to sign up. Every beta subscriber's discount ends on the same date, worked out from the end of the beta marketing period.
7.3 Where the detail lives. How you are charged, what happens if a payment fails, and how you cancel are set out in the Subscription, Billing & Auto-Renewal Terms. That document governs; this section only repeats its headline rule.
7.4 Monthly or annual. You choose monthly or annual billing before you subscribe. The choice does not change when the beta rate ends, and there is no way to pre-pay to hold the discount for longer.
7.5 Notice before it ends. We will give you notice before the beta rate ends and the standard price starts.
8. What happens at public launch
8.1 The beta ends. When we launch publicly, the beta ends and these Beta Program Terms stop applying. Your subscription continues. The Terms of Service and the Subscription, Billing & Auto-Renewal Terms continue to govern it.
8.2 Your beta rate outlives the beta, but not by much. Launch does not end your discount on the day it happens. The beta rate runs through the beta period and for one year after the beta marketing period ends — a single date that is the same for every beta subscriber. If you join in October 2026 and someone else joins in December 2026, your discount and theirs end on that same date, not on your own anniversaries. The rate is tied to the beta, not to how long you have been subscribed.
8.3 After the beta rate ends. Your subscription continues automatically at the standard price unless you cancel. We will give you notice before that happens.
8.4 What we currently expect at launch. We currently expect to open signups to the public, release iOS and Android apps, open a free tier anyone can sign up for, and launch community features in January 2027.
8.5 What we are not promising. Section 8.4 is a statement of our current plans, not a promise, and it is not part of what you are paying for. Any of it may be delayed, changed or dropped. In particular:
- •a public free tier may launch later than January 2027, may have different limits than we expect, or may not launch;
- •community features may launch later, may work differently, or may not launch;
- •mobile apps may launch later or on one platform before the other;
- •a beta subscription gives you no entitlement to any launch feature, to any grandfathered plan, to early access, to a founder tier, or to any status, badge or benefit at launch beyond the beta rate described in Section 8.2.
8.6 Community and your content. The Service has no community or social features during the beta, and nothing you enter is visible to another member. The limited licence you grant in the Terms of Service covers operating the Service for you; it does not permit us to publish your content. If community features launch, participation will be optional, and anything that would make your content visible to other people will require a separate choice by you. We will not make beta content public by default.
8.7 If the launch scope changes what you pay for. If a change at launch materially reduces the core functionality of the plan you are paying for, you can cancel before it takes effect.
9. Feedback
9.1 We want it. Telling us what is broken and what is missing is the point of the beta. Use Submit feedback in the app where it is available to you, or email support@niedfitness.com.
9.2 The licence you give us. We may use anything you send us freely, for any purpose, without restriction, attribution, confidentiality obligation or payment to you, and you grant us a perpetual, irrevocable, worldwide, royalty-free, sublicensable licence to use it.
9.3 No obligation on us. We are not obliged to act on feedback or to tell you what we did with it.
9.4 Do not send us confidential material. Do not send us anything you consider confidential, anything belonging to your employer, or anything you are not free to give us on the terms in Section 9.2.
9.5 No compensation. Beta participation is not employment, engagement, consultancy or a contest. You are not entitled to payment, equity, credit or any other compensation for participating or for giving feedback.
10. Confidentiality — not required
10.1 The beta is not confidential. You are not under any confidentiality obligation, and you do not need our permission to talk about Nied Fitness. There is no non-disclosure agreement, no embargo and no gag clause in these terms.
10.2 You may discuss it publicly. You are free to write about the Service, review it, post screenshots of your own screens, discuss its features, criticise it, and say what you paid. We will not retaliate against you for an honest public account of your experience, and nothing in these terms conditions your subscription, your price or your access on saying anything positive about us.
10.3 One thing we ask. If you describe a pre-release or in-development feature, please make clear it is not final and is subject to change, so that people reading you do not rely on something that may never ship. This is a request, not an obligation.
10.4 Two things you must not do. You may not share your sign-in details or give another person access to the Service through your account. You may not extract, redistribute or republish the exercise animations and other media in the app: they are licensed to us, not to you, and the Terms of Service forbids scraping and reselling.
10.5 Our confidential information. If we separately mark something as confidential and you agree to receive it on that basis — for example under a separate written agreement to test an unreleased feature — that separate agreement governs it. Nothing in the ordinary beta Service is confidential.
10.6 If you are paid to promote us. We are not paying anyone to promote the Service. If that ever changes, anyone posting under such an arrangement must disclose it clearly and conspicuously wherever they post.
11. How the beta ends, and how your participation ends
11.1 The beta ends at public launch. These terms end automatically when the beta ends, without further notice. Section 8 sets out what happens to your subscription.
11.2 We may end the beta early. We may end the beta earlier than expected, extend it, or change how it works, at any time. If we end it early, we will tell you beforehand where we reasonably can, and your subscription and beta rate continue under Sections 7 and 8 unless we discontinue the Service entirely.
11.3 If we discontinue the Service. If we shut the Service down rather than launching it, we will tell you before it happens. Your subscription ends and you will not be charged again.
11.4 You may leave at any time. Cancel from Account → Subscription → Manage subscription, which opens our payment processor's billing portal. The Subscription, Billing & Auto-Renewal Terms govern what happens when you cancel.
11.5 We may end your participation. We may suspend or end your beta access under the Terms of Service, including for a breach of its acceptable-use rules, or for non-payment.
11.6 What survives. The following survive the end of the beta and the end of your participation: Section 5.7 (liability), Section 6.4 (no compensation for data loss), Section 9 (feedback), Sections 10.4 and 10.5 (credentials and media, and our confidential information), and this Section 11.6.
